Pennsylvania Woman, Lawyer, File Fosamax Femur Fracture Lawsuit
With the help of a femur fracture lawyer, a Pennsylvania woman last month filed a lawsuit in New Jersey District court alleging that a generic version of the osteoporosis drug Fosamax caused her to suffer a thigh bone fracture.
Last month, Theresa Metz of Pennsylvania filed a lawsuit against Merck Sharp & Dohme Corp., (the name that Merck & Co., maker of Fosamax, operates under outside of the United States and Canada) alleging that a generic version of the osteoporosis drug Fosamax caused her to suffer a no-impact thigh bone break.
According to the complaint filed in the U.S. District Court of New Jersey, Metz had been taking generic Fosamax manufactured by Merck Sharp & Dohme for approximately one year when her femur fractured as she was walking down a sidewalk. As a result of her injuries, two titanium rods were inserted into Metz’s femur. Additionally, complications arose during her surgery that required a stay in the intensive care unit (ICU) and a blood transfusion. Afterwards, she underwent physical therapy and to this day still requires a cane to walk. Metz is seeking both compensatory and punitive damages in the product liability suit against Merck. She alleges that the pharmaceutical manufacturer designed a defective product and failed to warn of the drug’s health risks.
Fosamax (alendronate sodium) belongs to a class of drugs known asbisphosphonates that have been increasingly associated with abnormal femur fractures, so-called because the thigh bone can break due to falls from a standing height or less. In February a study appearing in the Journal of the American Medical Association (JAMA) found that women aged 68 years and older who have been taking Fosamax for an extended period are at significantly higher risk of suffering an atypical femur fracture. These findings correspond with two previously published studies that similarly concluded that Fosamax use is associated with low and no impact femur fractures.
With femur fracture lawsuits mounting, Merck recently requested that all such cases be consolidated and centralized before a single federal judge through a process known as multidistrict litigation (MDL). The company is also in the process of defending charges that Fosamax causes degeneration of the jaw bone, with a decision having been reached in at least one of these cases. To date, approximately 1,000 people have filed Fosamax lawsuits against Merck.
